Terms

Agreement

These Terms govern your access to and use of the Thin Place website, iOS application, and related services (collectively, the "Service") provided by Beacon and Balance LLC ("Thin Place," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years old to use the Service. If you are under the age of legal majority where you live, you may use the Service only with permission from a parent or legal guardian who agrees to these Terms on your behalf. You may not use the Service if applicable law prohibits you from doing so.

License and App Store terms

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable license to access and use the Service for its intended purposes. Thin Place is licensed, not sold.

If you obtain the app through Apple's App Store, your license to the app is also subject to Apple's Standard Licensed Application End User License Agreement. These Terms supplement rather than replace that agreement and the applicable App Store rules.

Your account

You are responsible for maintaining the security of your account and for activity performed through it. Provide accurate information, protect your sign-in method, and notify us if you believe your account has been compromised.

Your content

You retain ownership of prayers, reflections, ritual details, journal-like entries, feedback, and other content you submit to the Service ("User Content"). You grant Thin Place a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, adapt, transmit, and display User Content only as reasonably necessary to operate, secure, provide, and improve the features you request. This license allows us to use service providers for those purposes and ends when the content is deleted from our systems, except for reasonable backup, legal, and security retention.

You represent that you have the rights necessary to provide User Content and permit us to process it as described in these Terms and our Privacy Policy. You are responsible for your User Content and should not submit content that is unlawful or infringes another person's rights.

Subscriptions and purchases

The Service may offer subscriptions, in-app purchases, or other paid features. Prices, billing periods, trial terms, and renewal details will be shown at purchase. Unless stated otherwise, subscriptions renew automatically until canceled through the account or platform that processed the purchase.

Purchases made through Apple or another platform are processed and refunded under that platform's terms and applicable law. You are responsible for taxes and charges associated with your account. We may change prices prospectively after providing any notice required by law or the applicable platform.

Content removal and account termination

We may investigate violations and remove or restrict content, features, or accounts when we reasonably believe it is necessary to enforce these Terms, protect users or the Service, comply with law or a legal request, address risk or inactivity, or discontinue all or part of the Service. We may act with or without prior notice when reasonably necessary. You may stop using the Service and request account deletion at any time.

When access ends, the license granted to you ends immediately. Provisions that by their nature should survive will remain in effect, including provisions concerning ownership, disclaimers, liability, indemnification, and disputes.

Spiritual guidance and automated output

Thin Place offers general Christian spiritual-practice guidance and related tools. It does not provide medical care, mental-health treatment, crisis services, legal advice, or professional pastoral counseling. The Service is not a substitute for qualified professional support or emergency services.

Spiritual guidance and automated or AI-generated output may be incomplete, inaccurate, or unsuitable for your circumstances. Use your own judgment and seek qualified support when appropriate. If you are experiencing an emergency or crisis, contact local emergency services or an appropriate crisis resource.

Third-party services and content

Thin Place may rely on or link to services and content provided by Apple, Clerk, YouVersion, Sentry, and other providers. Their services, content, availability, and data practices may be governed by their own terms and policies. We are not responsible for third-party services outside our control.

Ownership and feedback

Thin Place, its design, software, and original content are owned by Beacon and Balance LLC or its licensors. Scripture and other third-party materials remain the property of their respective owners and are used under applicable licenses.

If you provide suggestions or feedback, you grant us a perpetual, irrevocable, worldwide, royalty-free right to use it without restriction or compensation, provided we handle personal information in accordance with our Privacy Policy.

Availability and changes

We may update, suspend, or discontinue features as the service evolves. We aim to provide a reliable experience but do not promise uninterrupted or error-free operation.

Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available." Beacon and Balance LLC and its affiliates, licensors, and providers disclaim all express, implied, and statutory warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and security. We do not guarantee any particular spiritual, personal, or other outcome.

Limitation of liability

To the fullest extent permitted by law, Beacon and Balance LLC and its affiliates, officers, employees, licensors, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business, arising from or related to the Service.

To the fullest extent permitted by law, their total aggregate liability for all claims arising from or related to the Service will not exceed the greater of US $100 or the amount you paid to Thin Place for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Beacon and Balance LLC and its affiliates, officers, employees, licensors, and providers from claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising from your User Content, your misuse of the Service, or your violation of these Terms or another person's rights.

Governing law and courts

These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. You and Beacon and Balance LLC consent to the exclusive jurisdiction and venue of the state and federal courts located in New York County, New York. Mandatory consumer protections available where you live remain unaffected.

Changes to these terms

We may update these Terms prospectively. We will update the date above and provide reasonable notice of material changes. Continued use after revised Terms take effect constitutes acceptance where permitted by law. If you do not agree to revised Terms, you must stop using the Service.

General terms

These Terms and policies incorporated by reference are the entire agreement between you and us concerning the Service. If a provision is unenforceable, it will be modified to the minimum extent necessary and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with our business or the Service.
